§ 10-550. Access to broad-tipped markers and paint sticks.

  • (a)

    It shall be unlawful for any person, other than a parent or legal guardian, to sell, exchange, give, loan, or otherwise furnish, or cause or permit to be exchanged, given, loaned, or otherwise furnished, any permanent broad-tipped marker or paint stick to any minor.

    (b)

    For purposes of this section, the actions of an employee shall not be attributable to an employer if:

    (1)

    The employer requires its employees to attend a training program regarding this section;

    (2)

    The employee has actually attended such a training program; and

    (3)

    The employer has not directly or indirectly encouraged the employee to violate this section.

Editor's note

Section 5 of Ord. No. 06-1055 states that this § 10-550 shall take effect on the sixtieth day next following the date of passage and approval of this Ordinance. All other portions of this Ordinance shall take effect immediately upon its passage and approval by the Mayor.
