§ 20-209. Vending machine locations.

  • (a)

    Vending machines, ovens and other equipment shall be located in a room, area or space which can be maintained in a clean condition and which is protected from overhead leakage or condensation from water, waste or sewer piping. The immediate area in which the equipment is located shall be well-lighted and ventilated. Each vending machine shall be located so that the space around and under the machine can be easily cleaned and maintained, and so that insect and rodent harborage is not created.

    (b)

    The floor area where vending machines are located shall be reasonably smooth, of cleanable construction, and capable of withstanding repeated washing and scrubbing. This space and the immediate surroundings of each vending machine shall be maintained in a clean condition.

    (c)

    Adequate hand-washing facilities, including hot and cold or tempered running water, soap and individual towels, shall be convenient to bulk food machine locations and shall be available for use by employees servicing or loading bulk food machines.

    (d)

    In operations where vending machines are rented, leased or owned by persons other than the holder of the commissary food dealer's permit, the facilities for cleaning and hand-washing, and for garbage and refuse storage and disposal may be provided by persons owning, renting or leasing the vending machine(s) or by other persons. However, it is the responsibility of the holder of the commissary food dealer's permit to see that all of the requirements of this article are fulfilled.

    (e)

    Outdoor food vending areas, overhead protection. If located outside, a machine used to vend food shall be provided with overhead protection except that machines vending canned beverages need not meet this requirement.
