§ 23-36. Disposal of waste prohibited.

(a)

It shall be unlawful for any person to dispose, discharge, or cause to be disposed or discharged, within the control area any waste regardless of whether the waste was originally removed from the lake or originated elsewhere.

(b)

It shall be an affirmative defense to subsection 23-36(a) that

(1)

The person has a current permit, and

(2)

Any disposal or discharge is in compliance with the permit.

(c)

The city expressly reserves the right to exercise and pursue any and all procedures and remedies available to it to protect its property rights including, but not limited to, removal of any material as described herein that encroaches into or upon the lake.
