§ 47-3. Responsibility to repair, replace, etc., facilities installed by former water control and improvement or fresh water supply district.

  • In those instances where a water control and improvement or fresh water supply district has installed water and sanitary sewer and drainage facilities in undeveloped areas and such district is thereafter annexed by the city and abolished as provided by law, any person desiring to subdivide, develop or build in any such area shall bear the cost and expense of repairing, replacing, testing and placing such facilities in operational condition acceptable to the director, as and until such time as any such person desiring to use any such facilities has, at his own cost and expense, placed such facilities in such proper operational condition, no building permits within such area shall be issued by the city, and no connections for services from any such facilities will be allowed by the city.
