§ 40-503. Penalties.

(a)

Except as otherwise provided for in this article:

(1)

Any violation of any provision of this article is a misdemeanor punishable upon conviction by a fine not to exceed $500.00 for each offense. Each day a violation continues shall constitute a separate offense.

(2)

Prosecution or conviction under this article is cumulative of and shall not be a bar to any other civil or administrative remedy provided or allowed in this article or by law.

(b)

When an existing agreement with the city for facilities in the public right-of-way contains the same provisions as this article, then the agreement's penalties for violation of that provision shall apply unless the agreement is silent with regard to penalties.
