§ 40-495. Installation.

  • (a)

    The facilities owner shall provide written notice to the city engineer fourteen days prior to:

    (1)

    Conducting routine maintenance that does not require excavation or closing of a sidewalk or vehicular lane in a public right-of-way;

    (2)

    Replacing or upgrading a network node that is substantially similar in size or smaller and that does not require excavation or closing of a sidewalk or vehicular lane in a public right-of-way. Substantially similar has the meaning set forth in Section 284.157(b)(1) of the Texas Local Government Code; or

    (3)

    Conducting the installation, placement, maintenance, operation, or replacement of a micro network node that is strung on cables between existing poles or node support poles, in compliance with the National Electrical Safety Code.

    (b)

    The written notice required in section 40-495(a) of this Code shall be mailed or delivered to the city engineer and contain the following information:

    (1)

    Date work is set to commence;

    (2)

    Description of the work;

    (3)

    Name of company conducting the work in the public right-of-way; and

    (4)

    Name of contact person and contact information.

    (c)

    The facilities owner, at the owner's sole expense, shall restore the public right-of-way to the condition in which it was before the facilities owner began work in the public right-of-way.

    (d)

    The facilities owner shall install facilities in compliance with the plans approved in writing by the director.
